Agreement and service operator
These Terms of Service govern access to FieldMaestro and My Home Maestro websites, applications, portals, communications, and related services operated by Viper Tool Solutions Inc. (“FieldMaestro,” “we,” “us,” or “our”). By accessing or using a service, you agree to these terms. If you use FieldMaestro for an organization, you confirm that you have authority to act for it.
A plan, order, signed agreement, feature notice, or organization-specific policy may add terms for a particular service. If it conflicts with these general terms, the more specific agreement controls for that service.
Accounts and organizations
- Provide accurate account information and keep it current.
- Protect credentials and promptly report suspected unauthorized access.
- Use assigned roles and permissions only for legitimate organization work.
- Organization administrators control membership, permissions, configured features, and many records.
- You are responsible for activity performed through your account unless caused by our breach of duty.
Customer data and permissions
You and your organization retain the rights you hold in information submitted to FieldMaestro. You grant us the limited rights needed to host, process, secure, display, transmit, back up, and otherwise provide the requested service. This permission continues only as needed to operate the service, honour valid organization instructions, and meet legal obligations.
You must have the authority and required notices or consents to upload, record, communicate, publish, or share information about workers, customers, properties, vehicles, calls, photos, financial activity, or other people. Public links and customer-portal sharing should be used only for information appropriate for the intended audience.
Acceptable use
You may not use FieldMaestro to:
- break the law, violate another person’s rights, or evade a legal or regulatory obligation;
- send spam, deceptive communications, prohibited content, or messages without required permission;
- upload malware, disrupt the service, bypass security, probe systems without authorization, or misuse credentials;
- access, alter, or disclose records outside your legitimate role;
- misrepresent identity, affiliation, work performed, or the origin of a communication; or
- use automated access in a way that harms reliability or circumvents plan or usage controls.
Service communications
We may send notices reasonably necessary to administer an account or service, including security, authentication, billing, legal, reliability, and material service notices. Organizations may separately use FieldMaestro to communicate with their own workers and customers. Communication delivery depends on the recipient information, permissions, providers, networks, and settings involved and is not guaranteed to be immediate or error-free.
FieldMaestro SMS terms
Program: FieldMaestro Alerts provides transactional app notifications to people who choose to receive them. Messages may include account activity, security notices, quotes awaiting review, appointments, project or job schedule changes, service updates, and similar requested alerts. A contractor, organization, customer, or project name may appear as context in a FieldMaestro-branded message.
Consent: SMS consent is optional, is not a condition of purchase, and must be separate from email consent and acceptance of other agreements. Message frequency varies. Message and data rates may apply. For programs requiring double opt-in, the subscriber must affirmatively reply to the confirmation message before the subscription is complete.
Stop or get help: Reply STOP to cancel. Reply HELP for help, or contact hello@fieldmaestro.ca. After a valid STOP request, a confirmation may be sent and no further program messages will be sent unless the recipient opts in again. Carriers are not liable for delayed or undelivered messages.
Mobile numbers and SMS opt-in or consent data are handled as described in our Privacy Policy. They are not sold or shared with third parties or affiliates for promotional or marketing purposes.
Connected services and financial features
Integrations are optional unless an applicable plan or order says otherwise. When an authorized user connects another provider, that provider’s terms and privacy practices also apply. You are responsible for connection authority, configuration, and reviewing imported or synchronized records. FieldMaestro is not a bank, accounting firm, payment institution, legal adviser, or tax adviser, and connected data does not replace professional review.
AI and automated assistance
AI and automation features may produce drafts, classifications, summaries, matches, or suggestions. Output can be incomplete, outdated, or incorrect. You remain responsible for reviewing output before using it in a quote, contract, financial record, safety decision, customer communication, or other consequential workflow. Do not rely on automated output as professional, legal, financial, medical, or safety advice.
Plans, billing, and changes
Paid features, included usage, billing periods, taxes, overages, cancellation, and renewal are described in the applicable plan, order, or checkout disclosure. Provider-priced communications or other metered services may have separate limits or charges. We may improve, replace, or discontinue features, but will provide notice when a change materially affects a paid service and notice is reasonably possible.
FieldMaestro ownership and feedback
FieldMaestro, My Home Maestro, product interfaces, software, branding, documentation, and original service materials are owned by Viper Tool Solutions Inc. or its licensors and are protected by applicable law. These terms do not transfer that ownership. If you provide feedback, you permit us to use it to improve the services without an obligation to compensate you, provided we do not publicly identify you without permission.
Availability, suspension, and termination
Services may occasionally be unavailable because of maintenance, provider outages, security events, or circumstances beyond reasonable control. Preview, beta, or experimental features may change and should not be used as the sole system for critical operations.
We may limit or suspend access when reasonably necessary to protect the service or others, respond to legal requirements, prevent abuse, address unpaid amounts, or investigate a material breach. You may stop using the service, and an authorized administrator may cancel according to the applicable plan or order. Data export and deletion are subject to account controls, retention obligations, and the Privacy Policy.
Disclaimers and responsibility
To the extent permitted by law, services are provided on an “as available” basis without a guarantee that every feature will be uninterrupted or error-free. Neither party is responsible for indirect or consequential loss that could not reasonably have been anticipated. Nothing in these terms excludes rights, warranties, or liability that applicable law does not allow to be excluded. Any service-specific liability terms in an applicable signed agreement or order take priority over this section.
Applicable law, changes, and contact
Unless a more specific agreement says otherwise, these terms are governed by the laws applicable in Ontario, Canada, without limiting mandatory rights that apply where you live. If part of these terms cannot be enforced, the remaining terms continue to apply.
We may update these terms as the services and legal requirements evolve. We will update the effective date and provide additional notice for a material change where required. Continued use after an updated version takes effect constitutes acceptance to the extent permitted by law.
